Anthem Seeks Court Extension for Merger Efforts

On Monday, May 8, Anthem petitioned the Delaware Court of Chancery to grant a 60 day extension of its current restraining order preventing Cigna from going forward with its plans to terminate the $54 billion acquisition between the two mega-insurers.  The termination deadline had been extended to April 30 prior to the original District Court ruling last February.  Anthem had been granted a hearing on the new extension petition for May 8.

Anthem has asked for the injunction while it seeks a hearing before the Supreme Court.  The insurer has filed a “writ of certiorari” to have SCOTUS review the U.S. District Court’s ruling that favored the DOJ’s anti-trust challenges to the merger.
